1. Use of the bioKneX website ("the site")
1. 1.1This section of the Site sets out the terms and conditions that apply to use of this Site by you (“the Terms”). For the purposes of the Terms, “we”, “us” or “ours” means BioKneX and (where the context permits) its employees, officers, directors, collaborators and sponsors. You may print out and keep a copy of the Terms.
2. 1.2 The Terms are a legal agreement and may only be modified with our consent. We reserve the right to change the Terms and any such changes will be posted here; any such changes will take effect immediately upon posting, whether you have reviewed them or not. By using this Site you are agreeing to the Terms; if you do not agree with any of these Terms you should cease using this Site immediately.
3. 1.3We endeavour to ensure that the Site is available for use 24 hours a day but accept no responsibility if the Site is unavailable at any time or for any period. We reserve the right to temporarily or permanently discontinue the Site at any time.
4. 1.4 If we make any software owned or operated by a third party available to you via the Site, you must use this software in accordance with any terms and conditions imposed by the third party.
5. 1.5 We do not warrant that your use or access to the Site will be uninterrupted or error or virus free.
6. 1.6 Hypertext links to any third party websites are provided solely for your convenience, but if you use these you do so at your own risk and will leave this Site. BioKnex is not responsible for the content of external websites.
2. Becoming a Registered User
1. 2.1 The following information explains the Terms of becoming a registered user of the Site. By completing an application form containing personal information you are agreeing to become a registered user of the Site subject to both the following Terms and also to the other terms and conditions posted on this Site. If you do not wish to become a registered user or agree to any of the Terms (including in particular the Privacy Policy herein concerning the use of personal information) then you should not complete the application form and cease using the Site.
  2.2 We reserve the right to refuse your application to become a registered user without giving any reason therefore.
  2.3 You are not required to provide all the personal information specified by us but, if you do not, then you may not be able to become a registered user and visit all sections of the Site.
  2.4 We reserve the right to exclude registered users from the Site on a permanent or temporary basis at our discretion and without giving any reason.
  2.5 You may cease being a registered user at any time by notifying us in writing or by email info@bioKneX.org.
  2.6 If you fail to comply with any of the Terms relating to being a registered user or the other terms and conditions posted on the Site, we may in our discretion revoke your registered usership by notice in writing or by email with immediate effect.
2. 3. Accuracy and Use and Disclaimer of Liability
3. 3.1 The Site is open to registered users as a showcase and networking forum. While we hope that the Site will be of interest to registered users and we use reasonable endeavours to ensure the relevance and suitability of the content of any material, articles, information or opportunities on the Site, we do not warrant or make any representations as to the accuracy of any such material, articles, information or opportunities or that the same are complete or up to date. If you wish to rely on any such material, articles, information or opportunities you must carry out your own research and not rely on the contents of the Site. In addition, in relation to any potential investment or commercialisation opportunities, these are placed on the Site by registered users by way of general information only. We do not and do not intend to offer any financial or investment advice to anyone using the Site or make any warranties or representations about the suitability (or otherwise) of any opportunities for investment or any other commercial arrangements that may be referred to on the Site or that you may be interested in making with any registered user (or any other third party).   3.3 We do not necessarily endorse nor are we responsible for the accuracy of or reliability of any opinion, advice or statement made on the Site.

  3.5 We provide use of the Site free of charge and do so on the basis that we have no liability for the use of the Site or the information or material therein. We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentations that cannot under English law be excluded. 5. 4.1 All rights reserved. All material on this Site (including without limitation content, information, software, photographs, sounds, text, graphs, forms, graphics, ideas, reports, notes and articles) (“Material”) is subject to copyright, database and other intellectual property rights unless otherwise indicated.
  4.2 Material may be downloaded to file or printer for personal use only without requiring specific prior consent [and no permission is required to establish hypertext links to this Site].
  4.3 You acknowledge that you do not acquire any ownership rights by downloading any copyright Material. The consent to use and reproduce any Material does not extend to altering or deleting any copyright or trademark notices or to using any Material on this Site that is identified as the copyright of a third party and authorisation to reproduce such Material must be obtained from the copyright holders concerned. 7. 5.1 We are committed to ensuring that your privacy is protected and this policy sets out how we intend to collect and use any personal information on the Site. By becoming a registered user and using the Site you are agreeing to the terms of this Policy. This Policy sets out how we intend to collect and use any personal information on this Site. “Personal information” as used in this Policy means information relating to you as an individual such as name, address, job title, employer, professional interests, size of employer’s business and contact details [others?   5.9 Cookies
  The internet is not a secure medium. However, we have put in place various security procedures as set out below: Netscreen 1000 hardware firewall. Our servers are hosted in a secure, facility managed area with 24/7 manned security. Access to the servers is protected by strict password control policies. All administration areas of bioknex.org are password protected.
  Like most websites, this Website sometimes makes use of browser “cookies” which are pieces of information which a Website either transfers to your computer hard drive or stores temporarily in your computer’s memory for record keeping purposes. We use cookies in order to allow us to statistically monitor how you are using the Website. Most browers are initially set up to accept cookies. 9. 6.1 We encourage registered users of the Site to contribute to the Site by posting messages or information on bulletin or message boards and by contributing articles or other information. You may also wish to contact other registered users whose details are posted on the Site. You should ensure that any articles, features, reports, views or information that you send to us or other registered users or publish or post on any bulletin or message board (“Posting”) on the Site are :

  not libellous, obscene, menacing, threatening, offensive, abusive, fraudulent, criminal, discriminatory, harassing, in breach of privacy or infringes the rights of other persons or is in any way illegal;

  not in breach of anyone else’s rights, such as copyright or database rights and if you are in any doubt you should provide a hypertext link.
  It is a condition of you being a registered user that you accept responsibility to ensure that you comply with the provisions regarding Postings and you must indemnify us for any costs, losses, liability or damage we suffer if you breach these provisions or any other provisions of the Terms.
  We accept no responsibility or liability for the content of any Postings irrespective of whether we have edited these or not. You acknowledge that you may be exposed to Postings from users that you may find offensive or which may be inaccurate and if you do so you should notify us as soon as possible info@bioKneX.org.
  You must not allow any unregistered user to make any Postings.
  You waive your moral rights to be identified as the author of any Posting and we may at our discretion exclude, reject, modify or alter the Posting (including cutting it to fit the Site). If there are any restrictions on any Posting you must notify us in advance.
  Any Posting received by us will be assumed to be for publication on the Site and for use on a worldwide royalty free, perpetual basis.
  We reserve the right to limit the number, size, format and content of any Postings made by a registered user.
10. 7. Legal Jurisdiction and Dispute Resolution
11. 7.1 We control the Site from the United Kingdom and we make no warranty that the Site or any material or information on it or use or processing by us of personal information from you complies with any laws other than those of England. If you access the Site from anywhere other than the United Kingdom you must ensure compliance with local laws.
  7.2 English law shall apply to these Terms notwithstanding any other jurisdiction where you are or access the Site. You irrevocably agree that the courts of England shall have the exclusive jurisdiction to settle any dispute that may arise in connection with the Terms of the Site and you submit to the exclusive jurisdiction of such courts.
  7.3 All communications connected with the Site must be in English.
  7.4 The Site is owned and operated by BioKneX, which is owned and operated by Nottingham Trent University (NTU). BioKneX is also sponsored by The University of Nottingham, The University of Leicester and BioCity Nottingham. BioKneX receives funding from the three Universities and the East Midlands Development Agency.

  7.6 The trademark BioKneX TM used and displayed on this Site is the trademark of Bioknex, the east midlands bioscience knowledge exchange which is owned and operated by NTU on behalf of itself and other bioknex sponsors in the United Kingdom and other countries. Other brand names, trademarks and logos used and displayed on this Site are registered or unregistered trademarks of others in the United Kingdom and other countries. Neither BioKneX TM nor any of the other trademarks, names or logos may be used in any advertising or other publicity material in relation to the distribution of any information or materials obtained from the Site without the prior written consent of the relevant trademark owner.
